De Nederlandse Immigratie- en Naturalisatiedienst (<a href=\"https:\/\/ind.nl\/\" target=\"_blank\" data-type=\"link\" data-id=\"https:\/\/ind.nl\/\" rel=\"noreferrer noopener nofollow\">IND<\/a>) heeft haar leges voor aanvragen van verblijfsvergunningen voor onderdanen van derde landen daadwerkelijk verlaagd van \u20ac405,00 naar \u20ac81,00.<\/strong><\/p>\n\n\n\n<p>Dit is goed nieuws: lagere administratieve barri\u00e8res maken naleving toegankelijker. Toch werpt de uitspraak ook een scherper licht op een dieper liggend structureel probleem binnen de Nederlandse arbeidsmarkt: een probleem dat CIS op de voet volgt.<\/p>\n\n\n\n<p>Duizenden onderdanen van derde landen (<a href=\"https:\/\/cis-bv.com\/nl\/home\/onderdanen-van-derde-landen\/\">TCN's<\/a>) werken momenteel in Nederland onder intracommunautaire dienstenregelingen. Zij hebben een geldige werkvergunning, maar vaak niet de vereiste verblijfsvergunning na 90 dagen. Hoewel het Hof van Justitie heeft bevestigd dat zo'n vergunning verplicht is na die drempel, blijft de handhaving in de praktijk inconsistent. Certificeringsinstanties zoals <a href=\"https:\/\/www.normeringarbeid.nl\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">SNA<\/a>, via de NEN 4400-2 norm, controleer alleen op werkvergunningen en <em>niet<\/em> voor <a href=\"https:\/\/cis-bv.com\/nl\/diensten\/verblijfsvergunningen\/\">verblijfsvergunningen<\/a>, waardoor een blinde vlek in het systeem ontstaat.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Het resultaat?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Werknemers kunnen legaal in dienst zijn maar illegaal verblijven.<\/li>\n\n\n\n<li>Gecertificeerde bedrijven kunnen (on)bewust de immigratiewet overtreden.<\/li>\n\n\n\n<li>Adviseurs staan voor een ethisch dilemma: naleving aanmoedigen en klanten verliezen, of wegkijken om concurrerend te blijven.<\/li>\n\n\n\n<li>Bedrijven die zich aan de regels houden, worden weggeconcurreerd door bedrijven die deze maas in de wet gebruiken.<\/li>\n<\/ul>\n\n\n\n<p>Hoewel de verlaagde tarieven een stap voorwaarts zijn, blijft het onderliggende nalevingsprobleem bestaan. Tenzij het controleren van de verblijfsstatus een kernvereiste wordt van certificerings- en auditprocessen, loopt het Nederlandse systeem het risico om illegaliteit te institutionaliseren onder de vlag van \u201czelfregulering\u201d.\u201d<\/p>\n\n\n\n<p>Bij CIS verwelkomen we deze kostenbesparing, maar we roepen op tot een bredere heroverweging: eerlijke concurrentie en naleving van de wet moeten hand in hand gaan.
